The Gurugram District Office has taken a proactive step to ensure workplace safety and prevent sexual harassment. They’ve issued a compliance checklist for organizations to adhere to the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 (POSH Act).

Gurugram District Office Reinforces Sexual Harassment Prevention with POSH Compliance Checklist, Annual report to be submitted by April 30, 2024.

This checklist, released on December 20, 2023, is designed to help government and non-government agencies prepare their mandatory annual reports due by April 30, 2024.

As per the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013, all employers having Ten (10) or more employees are covered under the POSH Act.

Who is an Employee?

Section 2 F of POSH Act has defined employee as “employee” means a person employed at a workplace for any work on regular, temporary, ad hoc or daily wage basis, either directly or through an agent, including a contractor, with or, without the knowledge of the principal employer, whether for remuneration or not, or working on a voluntary basis or otherwise, whether the terms of employment are express or implied and includes a co-worker, a contract worker, probationer, trainee, apprentice or called by any other such name; Kindly consult your legal advisor for more details.

Key Points of the POSH Checklist:

  • Policy: Organizations must have a clear policy on preventing sexual harassment.
  • Visibility: Notices outlining the policy and consequences of harassment must be displayed.
  • Awareness: Conduct training sessions to educate employees and offer support to victims.
  • Internal Committee: Establish a properly formed Internal Committee (IC) to handle complaints.
  • Action: Implement the IC’s recommendations promptly.
  • Corporate Compliance: Companies must include a statement in their accounts confirming POSH Act compliance.
